EDSB: „Opinion 2/2015“ zum Abkommen mit der EU und der Schweiz über den automatischen Informationsaustausch in Steuersachen (AIA) veröffentlicht

Der Europäische Datenschutzbeauftragte (EDSB) veröffentlichte am 8. Juli 2015 seine „Opinion 2/2015“ zum Abkommen mit der EU und der Schweiz über den automatischen Informationsaustausch in Steuersachen (AIA).

In diesem Zusammenhang hat der EDSB entschieden, den EU-Gesetzgeber anzurufen und für die Implementierung von gewissen datenschutzrechtlichen Schutzmassnahmen („data protection safeguards“) für künftige Abkommen ähnlicher Art im Bereich des automatischen Informationsaustausches in Steuersachen zu plädieren.

Konkret ist der EDSB der Auffassung, dass vorliegend die „basic data protection safeguards“ trotz der Bestimmung von Art. 6 („Vertraulichkeit und Schutz personenbezogener Daten“) des genannten Abkommens nicht vollständig umgesetzt wurden. Folgende Schutzmassnahmen („safeguards“) wären gemäss EDSB angemessen gewesen:

"(i) make the collection and exchange of tax-relevant information conditional on the effective risk of tax evasion;


(ii) limit the purpose of data processing to the pursuit of a legitimate policy goal (i.e. countering tax evasion), preventing use for additional purposes without informing data subjects;

(iii) provide for proper information of the data subjects as to the purpose and modalities of processing of their financial data, including the recipients of their data;


(iv) set forth explicit security and data protection standards to be complied with by private and public authorities engaging in the collection and exchange of tax information;

(v) provide for an explicit retention period applicable to the tax information exchanged and mandate for its deletion, once such information is no longer processed for the purpose of countering tax evasion".
